terms and conditions

The Terms "Photographer," "photography team," "us," "we," and "our" refer to Ede J. Sartori - Beyond Snapshot Photography and all agents, employees, or other representatives. The term "including" means "including, but not limited to. "The term "session," "event," and "photography session" or "photo session" refers to a hired photographic session to take custom photographs for outdoor portraits.

copyright

All photographic materials, such as digital images, shall be the exclusive property of the Photographer. The Photographer shall own the copyright to all images taken at the photo session and may use the work for examples, contests, exhibitions, advertising, and self-promotion.

client's usage

The Photographer does provide the Client permission to resize photographs for Internet-based or creating a non-profit advertisement for their business usage. The Client shall only use the photographic prints, including digital files, per the permissions stated in the Contract. The Client's images are for personal use only and shall not be submitted to contests or reproduced for commercial use. The Client can obtain prints for personal use only and is not authorized to sell or make images without the Photographer's written approval.

Social media 

This clause applies to all social media, including but not limited to Facebook, Twitter, Instagram, and blogs. When published online, it is required that a citation of the Photographer's name or business name be made. The Client agrees that they will not alter any photographs placed in public on the internet under no circumstances. The Client agrees to be responsible for any family member or friend who posts our photographs online and agrees that they cannot be cropped (except for the forced cropping for Facebook's Timeline), altered in color, or edited in any way without written authorization from the Photographer.
The Client may share web/blog post links and social media albums by using the share functions and dissemination of direct links. The Client shall not copy, download, screenshot, or capture the photographs in any other fashion. The Client shall identify the "Ede J. Sartori Photographer - Beyond Snapshot Photography" in the caption of all photographs uploaded to social media websites and profiles.

Booking, payment, Refund

The Client shall make a booking fee as per Contract to retain Beyond Snapshot Photography to perform the services specified in the Contract sighed by both parties.
The Client shall make a non-refundable retainer in the amount of "specified in the contract" for the Photographer to perform the services specified herein. Upon payment, the Photographer will reserve the time and date agreed upon by both parties. The Client agrees the Photographer earns this retainer in consideration of the experience, reputation, skill of the Photographer and in respect of the inability of the Photographer to schedule other Clients during this time.
Payment for product orders shall be submitted to the Photographer within 5 days of gallery delivery, whether via online proofing service or in-person viewing.
Any payment plan Contract agreed by the Photographer, and the Client shall be included as a supplement to the Contract. No images are delivered until the entire amount is paid in full.

Images provided to the client

The Client accepts that all photographs will be taken and edited at the Photographer's discretion based on the Photographer's experience and artistic view. If the Client has special requests, they shall create a "shot list" of all shots they require.
The Photographer will edit images available to the Client on an online gallery. If any changes require from the Client, it will be a fee charged per image according to the Contract.
It is understood that the Photographer is not responsible for fixing photos to cover parts of your body that you do not wish to be seen in the picture.
Images provided to the Client are in high resolution, in original sized JPEG format on an online gallery with the option select favorites and or download all or some only.

All photographic materials, including but not limited to negatives, transparencies, proofs, and previews, shall be the exclusive property of the Photographer. Clients must place all orders within the outlined schedules within the Contract. No products, including digital files, will be released until the agreed-upon amount is paid in full per the payment schedule outlined in the Contract.

The Photographer shall make gallery proofs available through an online gallery proofing website. These proofs shall be open to the Client within 10 days (unless specified in the Contract) of the photographic event. If an online proofing gallery is delivered, it shall remain open for 30 days from delivery. After expiring date to make it available for another 30 days, a fee will be charged a specified amount in the Contract.

Liability

The Client's responsibility is to take care of the children; Beyond Snapshot Photography will not accept any obligation due to any accident to children, adults, or damage to public or private properties during the photo shooting or consultation session.

Failure to perform

If the Photographer is unable to perform this Contract due to illness, emergency, fire, casualty, strike, an act of God, or causes beyond the control of the Photographer, the Photographer and the Client shall make every attempt reschedule the photographic event. If a reschedule is unable to be agreed upon, the Photographer shall return the retainer to the Client and shall have no further liability. Further, if the Photographer is unable to deliver photographic materials due to technological malfunctions, including but not limited to the equipment operation and image processing, or photographic materials are otherwise lost or damaged without fault of the Photographer, liability shall be limited to the cost of the Contract. In no event shall Photographer be liable for any amount exceeding the cost of the Contract.
This limitation on liability shall also apply if photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. If the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount above the retail value of the Client's order.

Standard Price List

The charges in the Contract are based on the Photographer's Standard Price List. This price list is adjusted periodically, and future orders shall be charged at the prices in effect when the order is placed.

Jurisdiction and Venue

The parties expressly consent to jurisdiction and venue of the federal and courts of the Province of British Columbia with respect to any suit, claim, or dispute arising out of or relating to this Agreement. The parties understand and agree that the Court where litigation is first commenced will retain jurisdiction over any and all related claims or disputes arising out of and concerning this Agreement. Depending on which Province any action may be commenced, this Agreement shall be deemed to have been made in such Province and shall be governed by and construed in accordance with the laws of such Province.

Indemnification

The Photographer shall be held harmless for any injury to the Client and the Client's property during the photographic event and the immediately surrounding events.

communication

All communication between Client and Photographer shall be made in email and English. I case of a phone conversation shall be confirmed by email.

Additional expenses

No travel expenses will be charged within 30 km from the Photographer's location. If the portrait session takes place at another location like parking, entrance fees, rentals, or related expenses payable by the Client.

Change Logs

We are not responsible for notifying Clients of updating our terms and conditions policy changes, and we will provide the date when we changed it on this page only.
